The developer/owner of the 54 W. Englewood property had – since the Spring of 2025 – volunteered to develop a multi-unit residential property that would include 11 affordable housing units.  But that developer does not now agree to construct that development facility to the specifications the Town approved in that property’s redevelopment plan early 2026.

The developer has sued Teaneck seeking a change in those specifications. The case was assigned to Judge Corriston who is also the judge who must decide whether Teaneck has met its 4th Round affordable housing obligations and therefore has immunity from builders’ remedy litigation. Teaneck has appointed a new attorney firm to defend the Town in this 54 W. Englewood case.

Residents have been told virtually nothing – but Voices has been able to access the court docket for this case. At the October 6 Teaneck Council, during his attorney’s report, Attorney Salmon alluded to a September 30 letter he had written to Judge Corriston which described the current status of settlement negotiations about those facility specifications. He suggested that a successful settlement of this 54 W. Englewood litigation could be linked to whether or not Teaneck is granted long-term immunity from builders’ remedy litigation. But in his 9/30 letter, Salmon says the two sides are not yet ready to approve a new consent order and that the judge should not expect a settlement until after the case conference meeting then scheduled for October 20.

However, two weeks later, on Wednesday October 14, Attorney Steinhagen for the 54W.Englewood developer wrote to Judge Corriston saying that  – yes – the two parties were engaged in settlement negotiations but needs a additional 30 days beyond the October 20 date – particularly since the settlement might affect whether Teaneck’s 4th Round affordable housing obligations. Voices also believes Teaneck residents should be given access to that 9/30 Salmon letter since it is publicly available in the docket record of that litigation.

Present Narr – 54 W. Englewood Suit

As can be seen from that court docket, since June, 2026, there has been subsequent quite hostile correspondence from both the plaintiffs attorney (developer’s attorney Steinhagen) and the defendant (represented by the specially hired the Township attorney firm).

Voices notes that if the settlement reached by the town and  the 54 W Englewood developer involves a reduction in the number of affordable housing units that property would provide, then – as Attorney Steinhagen hints – the compliance status of Teaneck with its 4th Round affordable housing obligations may be in jeopardy.
