  • Abbreviated Public Notice of the AUCC “Whispering Woods” Settlement Hearing –

“PLEASE TAKE NOTICE that the applicant, AUCC Family, Education and Faith Center (“Applicant”), the owner of the property located at 50 Oakdene Avenue, Township of Teaneck, New Jersey, 07666 also known as Block 3203, Lot 1 (hereinafter referred to as the “Property”), has made application to the Teaneck Zoning Board of Adjustment (“Zoning Board”) for a use variance, bulk variances and preliminary and final site plan approval (“Application”) to utilize and upgrade the existing school building on the Property for a community center with outdoor recreational facilities in addition to child-care and house of worship uses at the Property in the former P Public Land District (“P District”) which is currently known as the CCO Community Center Overlay District (“CCO District”)……..

The Applicant also requests any additional approvals, variances, waivers, exceptions or any other relief as may be identified by the Zoning Board during the Whispering Woods hearing.   The Zoning Board of Adjustment of the Township of Teaneck shall hold a public hearing on this matter on September 18, 2025 at 7:00pm in the Teaneck Municipal Building located at 818 Teaneck Road, Teaneck, N.J. 07666.   The public hearing will be held in accordance with the requirements of Whispering Woods v. Middletown Township, 220 N.J. Super. 161 (Law Division, 1987) to consider the terms of a settlement agreement entered into by the Applicant, and named plaintiffs, and the Teaneck Zoning Board, and named defendants, (the “Settlement”) regarding the lawsuit filed in United States District Court for the District of New Jersey, captioned AL UMMAH COMMUNITY CENTER et al v. TEANECK et al, Action No. 2:20-cv-14181 (the “Complaint”) with respect to the Zoning Board’s October 1, 2020 dismissal of the Applicant’s prior variance application. The instant Application and Settlement, if approved by the Zoning Board, will resolve the pending litigation in this matter. It is required by law that the Zoning Board hold a public hearing to review the instant Application, Settlement and plans and hear testimony in support of or in opposition to the Application. When the case is called you may appear either in person or by agent or attorney and present any objections which you may have to the granting of this Application. Legally, “The purpose of a Whispering Woods hearing is to put the terms of a settlement in front of the public at a land use board hearing and to have that board review any amendments to an application that are necessary as part of that settlement.”

It is widely rumored that this settlement will require the Township or its insurers to compensate this AUCC organization well in excess of $1M.
