A group of 14 Holy Name Medical Center (HNMC) Teaneck neighbors filed a new 40-page pleading on Wednesday August 10, 2022 that asks the state courts to invalidate the two ordinances Teaneck Council believes it passed on June 28 to expand the hospital’s zone and cede ownership of a portion of the Town’s Chadwick Road to the hospital.

The pleading restates allegations of procedural errors and conflicts of interest among town officials voting on the earlier hospital Master Plan amendments and the consequent zoning changes.  But added in this latest pleading are assertions that the entire process of simultaneous passage of Ordinances 22-2022 and 23-2022 on June 28 involved violations not only the Municipal Land Use Law (MLUL) but the Open Public Meeting Act (OPMA) and other statutes.

That pleading, which was submitted to the Superior Court in New Jersey Law Division in Bergen County by Attorney Robert F. Simon can be read in its entirety if you Click Here.
