Fiery Responses to Challenges to HEFSP

On August 26 and 27, 2025 just before the deadline, the Housing Compliance Program in the State Court received 6 separate challenges to the Teaneck Township’s Housing Element & Fair Share Plan (HEFSP). The text of those challenges are at 8-27 & 28 Suits Challenging HEFSP 
These challenges – if the State agrees – would throw into chaos how Teaneck will seek to meet its affordable housing obligations by March 2026.  Hence the Town must first persuade The Housing Dispute Program that in its June 2025 Housing Element and Fair Share Plan (HEFSP) the Township was compliant in meeting its 4th Round housing obligations. 

The Affordable Housing Dispute Resolution Program judicial program that must evaluate these challenges has set a hearing date to evaluate those challenges for Monday, October 6. 

Late Friday afternoon, October 3, 2025 Township Redevelopment Attorney Michael Ash filed a sharp 9-page response to/critique of the Fair Share Housing Center (FSHC) challenges. It was addressed to retired judge Hon. Thomas C. Miller, AJSC (ret.) at the Affordable Housing Dispute Resolution Program in Trenton.

Just before the scheduled 10/6 hearing, the Fair Share Housing Center responded sharply to the Ash 9-page submission. That response can be accessed at:
